TERMS & CONDITIONS, DISCLAIMER AND LIMITATION OF LIABILITY

By accessing, browsing, using or responding to any listing, advertisement, promotion or information published on the Connect50 Business Network Directory (“Connect50”), you agree to the following Terms and Conditions.

1. NATURE OF CONNECT50

Connect50 is a business marketing, advertising and networking platform that provides businesses and service providers with an opportunity to advertise their products and services to potential customers.

Connect50 is not the supplier, contractor, agent, representative, employer, partner or guarantor of any business, service provider or advertiser listed on the platform.

Unless specifically stated otherwise, Connect50 does not itself provide the products or services advertised by third-party businesses on the platform.

Any agreement entered into between a user and an advertiser is an agreement directly between those parties.

2. ADVERTISER SCREENING

Connect50 aims to maintain a professional and trustworthy business network and may take reasonable steps to establish that advertisers appear to be legitimate businesses or service providers and are in good standing at the time they join the network.

However, such checks must not be regarded as certification, accreditation, approval, endorsement or a guarantee by Connect50.

Business circumstances, ownership, staff, workmanship, service standards and financial circumstances can change. Connect50 cannot continuously monitor or guarantee the conduct or performance of every advertiser.

Users remain responsible for performing their own reasonable checks before appointing, purchasing from or making payment to an advertiser.

3. NO ENDORSEMENT OR GUARANTEE

The inclusion of any business, service provider, product or service in the Connect50 directory does not constitute an endorsement or recommendation by Connect50.

Connect50 makes no guarantee regarding:

  • The quality or standard of workmanship or services;
  • The quality, safety or suitability of products supplied;
  • Pricing, quotations or estimates;
  • Delivery or completion dates;
  • Warranties or guarantees offered by advertisers;
  • Qualifications, licences, registrations or certifications;
  • The accuracy of representations made by an advertiser;
  • The financial standing of an advertiser;
  • The conduct of an advertiser or its employees, contractors or representatives; or
  • The outcome of any transaction between a user and an advertiser.

Users appoint or purchase from advertisers at their own discretion and risk.

4. CUSTOMER RESPONSIBILITY

Before accepting a quotation, making a payment or appointing an advertiser, users are encouraged to verify information relevant to the service being requested.

Where appropriate, this may include requesting written quotations, checking references, confirming registrations or licences, reviewing guarantees and warranties, and ensuring that the scope of work, pricing and payment terms are agreed upon in writing.

Connect50 is not responsible for conducting these checks on behalf of users.

5. TRANSACTIONS ARE BETWEEN USER AND ADVERTISER

All quotations, contracts, deposits, payments, purchases, bookings, appointments, warranties, guarantees, repairs, replacements, refunds and other arrangements are strictly between the user and the relevant advertiser.

Connect50 is not a party to these transactions merely because the advertiser was discovered through Connect50.

Any dispute relating to a product or service must therefore be addressed directly with the relevant advertiser or service provider.

6. COMEBACKS, DEFECTS AND POOR WORKMANSHIP

Connect50 accepts no responsibility for any comeback, defective workmanship, incomplete work, incorrect work, delays, damages, repairs, replacements, warranty claims or additional costs arising from work performed or products supplied by an advertiser.

Any obligation to correct defective work, honour a guarantee, replace a product, refund a customer or compensate a customer remains the responsibility of the relevant advertiser, subject to applicable law and the agreement between the advertiser and customer.

7. REPORTING POOR SERVICE

Connect50 relies on its community to help maintain the quality and integrity of the network.

Users are strongly encouraged to report serious complaints, suspected fraudulent conduct, repeated poor service, unethical conduct or materially misleading advertising to Connect50.

Reports should, where possible, include supporting information such as invoices, quotations, photographs, correspondence or other relevant documentation.

Connect50 may investigate complaints at its discretion and may request a response from the advertiser.

Where Connect50 reasonably believes that an advertiser poses a risk to users, has repeatedly provided unacceptable service, has acted dishonestly or has materially breached Connect50’s advertising requirements, Connect50 reserves the right to suspend or remove the advertiser from the network.

Removal from Connect50 does not constitute a legal finding of guilt or liability.

8. CONNECT50 IS NOT A DISPUTE RESOLUTION SERVICE

Connect50 may, at its discretion, assist with communication between a user and an advertiser after receiving a complaint.

However, Connect50 is under no obligation to mediate, arbitrate, investigate or resolve disputes.

Connect50 cannot compel an advertiser to provide a refund, redo work, honour a warranty, pay damages or settle a claim.

Where necessary, users should obtain independent legal advice or approach the appropriate consumer protection, regulatory or dispute-resolution body.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by South African law, Connect50 and its owners, directors, employees, administrators, representatives, affiliates, marketing partners, service providers and associated businesses shall not be held liable for any loss, damage, expense, claim or liability arising from or connected with the acts or omissions of an advertiser or service provider listed on the platform.

This includes, without limitation, claims relating to:

  • Poor or defective workmanship;
  • Property damage;
  • Financial loss;
  • Loss of income or business;
  • Delayed or incomplete services;
  • Products that are defective, unsuitable or not delivered;
  • Deposits or payments made to advertisers;
  • Failed transactions;
  • Warranty or guarantee disputes;
  • Misrepresentation by an advertiser;
  • Negligence or misconduct by an advertiser;
  • Theft or fraudulent conduct by third parties; or
  • Any consequential or indirect loss.

Nothing in these Terms and Conditions is intended to exclude or restrict any liability that cannot lawfully be excluded under applicable South African law.

10. INFORMATION AND ADVERTISING CONTENT

Advertisers are responsible for ensuring that information supplied for publication is accurate, lawful and not misleading.

Connect50 may rely on information, photographs, descriptions, pricing, contact information and promotional material supplied by advertisers.

While reasonable efforts may be made to maintain accurate information, Connect50 does not guarantee that every listing will always be complete, current or error-free.

Users should confirm important information directly with the advertiser before entering into a transaction.

11. THIRD-PARTY WEBSITES AND COMMUNICATION

Connect50 listings may contain links or contact details directing users to third-party websites, WhatsApp accounts, social media pages, payment platforms or other external services.

Connect50 does not control these third-party platforms and is not responsible for their content, security, availability, privacy practices or transactions conducted through them.

12. ADVERTISER RESPONSIBILITY

Advertisers using Connect50 are responsible for their own conduct and must comply with all laws, regulations, industry requirements and consumer protection obligations applicable to their businesses.

Advertisers remain solely responsible for their employees, subcontractors, representatives, products, services, quotations, warranties, guarantees and customer obligations.

Advertising on Connect50 does not transfer any of these responsibilities to Connect50.

13. RIGHT TO REFUSE, SUSPEND OR REMOVE ADVERTISING

Connect50 reserves the right, at its reasonable discretion and subject to applicable law and any contractual obligations, to refuse, suspend or remove advertisements or advertisers that:

  • Provide materially misleading information;
  • Generate substantiated and serious customer complaints;
  • Engage in fraudulent, unlawful or unethical conduct;
  • Misrepresent their qualifications, products or services;
  • Damage or threaten the integrity or reputation of the network; or
  • Breach Connect50’s applicable advertising terms.

Connect50 is not obliged to continue providing advertising or directory access to a business merely because that business was previously accepted.

14. NO GUARANTEE OF ADVERTISING RESULTS

Connect50 does not guarantee that advertising on the platform will result in enquiries, leads, sales, bookings, contracts, revenue or any particular level of exposure.

Advertising fees, where applicable, are charged for access to the agreed marketing and advertising services and not for guaranteed business results.

15. INTELLECTUAL PROPERTY

The Connect50 name, branding, website design, directory structure and original content remain the property of their respective rights holders and may not be copied, reproduced or commercially exploited without permission.

Advertisers warrant that they have the necessary rights or permission to provide logos, photographs, text and other material submitted to Connect50 for advertising purposes.

16. PRIVACY AND PERSONAL INFORMATION

Connect50 will handle personal information in accordance with applicable South African privacy legislation, including the Protection of Personal Information Act (POPIA) where applicable.

Advertisers remain independently responsible for complying with POPIA and other applicable privacy requirements when collecting or processing customer information obtained through enquiries generated by Connect50.

17. SOUTH AFRICAN LAW

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Nothing contained in these Terms and Conditions is intended to remove, waive or restrict rights that a consumer may have under the Consumer Protection Act, 2008, POPIA or any other applicable South African legislation where such rights cannot lawfully be excluded.

18. CHANGES TO THESE TERMS

Connect50 may amend these Terms and Conditions from time to time to reflect changes to the platform, its services or applicable legal requirements.

The latest published version will apply from its stated effective date, subject to any rights or obligations that cannot lawfully be altered retrospectively.

19. GENERAL DISCLAIMER

The purpose of Connect50 is to connect consumers with businesses and service providers and provide those businesses with a marketing platform.

Connect50 will make reasonable efforts to promote a trustworthy network, but cannot guarantee the conduct, workmanship, products, services or performance of independent advertisers.

Finding a business through Connect50 should therefore not be interpreted as a guarantee that Connect50 will assume responsibility should something go wrong.

The final decision to appoint, purchase from or enter into an agreement with any advertiser remains with the customer, and the resulting contractual relationship is between the customer and that advertiser.
